INDEMNITY AGREEMENT

Between:
Grant Connects T/A Xhumanisa Eco-Safaris
(Hereinafter referred to as “the Service Provider”)
and
The Undersigned Participant (Hereinafter referred to as “the Participant”)

I, the undersigned, hereby acknowledge and declare that I voluntarily participate in tours, activities, safaris, transport arrangements, and any related events or services provided, facilitated, or arranged by Grant Connects T/A Xhumanisa Eco-Safaris, a sole proprietorship (the Service Provider), with effect from the ____ day of ___________ 20____.

  1. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK

I confirm that my participation is voluntary and undertaken entirely at my own risk. I understand that activities such as game drives, walking safaris, bush experiences, transport on public or private roads, interactions with wildlife, camping, and exposure to natural environments carry inherent risks, including but not limited to:

  • Dangerous wildlife encounters
  • Vehicle accidents
  • Falls, injuries, illness, dehydration, heat exhaustion
  • Theft or damage to property
  • Weather-related hazards, acts of nature, and unforeseen circumstances

I acknowledge that the Service Provider cannot guarantee my safety under all circumstances.

  1. SCOPE OF SERVICES

I acknowledge that the Service Provider’s services are specifically limited to:

  • Tour Guiding
  • Tour Arranging and Facilitation
  • Transport and/or Driving Services related to the tour

I further acknowledge that no guarantee, warranty, insurance coverage, fitness level assessment, or outcome of any activity is expressed or implied beyond these stated services.

  1. INSURANCE

I understand and accept that:

  • The tour is not covered by any public liability insurance or other policy in my name unless I have requested and secured such cover in writing, and the Service Provider has confirmed this in writing.
  • I am solely responsible for arranging my own medical, travel, evacuation, baggage, third-party liability, and personal accident insurance.
  1. WAIVER, INDEMNITY & LIMITATION OF LIABILITY

I hereby waive, abandon, and renounce any claim of any nature whatsoever against the Service Provider and its associated entities, including but not limited to employees, owners, subcontractors, agents, independent operators, service partners, suppliers, and facilitators (collectively “the Entities”).

I indemnify and hold harmless the Entities from any liability, loss, damage, injury, illness, death, legal costs, or expenses arising directly or indirectly from my participation, whether caused by:

  • Negligence
  • Human or mechanical error
  • Wildlife or environmental hazards
  • Third-party actions
  • Acts of God / Force Majeure events

Liability, if ever established against any Entity, is strictly limited to R2 500.00 (Two Thousand Five Hundred Rand) in total.

  1. HEALTH, MEDICAL FITNESS & EMERGENCY CONSENT

I confirm that:

  • I am medically fit to participate in all activities undertaken.
  • I have disclosed all relevant medical conditions, allergies, and limitations.
  • I am aware that remote areas may have limited access to medical assistance.
  • I consent to any emergency treatment deemed necessary, and accept full financial responsibility for such treatment, including medical evacuation costs.
  1. CONDUCT AND COMPLIANCE

I agree to:

  • Follow all instructions issued by the Service Provider and guides
  • Not behave in a manner that endangers myself, wildlife, property, or others
  • Accept that reckless or non-compliant behaviour may result in removal from a tour without refund
  1. MINORS

Where I sign on behalf of a minor:

  • I warrant that I am legally authorised to do so
  • I agree that such minor is bound by the terms of this waiver
  • I indemnify the Entities against any claim by or on behalf of such minor
  1. THIRD-PARTY PROVIDERS

If the Service Provider makes use of lodges, transport companies, charter flights, accommodation, restaurants, activity providers, or other third parties, I acknowledge that:

  • These providers operate independently
  • The Service Provider bears no liability for their acts, omissions, or negligence
  • Any claims must be addressed directly to the relevant third party
  1. CANCELLATION, FORCE MAJEURE & REFUNDS

No refunds shall be offered in the event of:

  • Natural disasters, weather disruptions, road closures, strikes, accidents, pandemics, or government restrictions
  • Participant withdrawal or failure to comply with instructions
  • Events beyond the control of the Service Provider

The Service Provider reserves the right to alter itineraries for safety or operational reasons without liability.

  1. BINDING EFFECT

This waiver:

  • Is binding upon my estate, heirs, dependants, executors, trustees, and assigns
  • Remains valid for all future tours undertaken with the Service Provider, unless revoked in writing
  1. DECLARATION

I confirm that:

  • I have read and understood this document in full
  • I was given adequate opportunity to ask questions
  • I sign this agreement voluntarily, without coercion or duress
  • I fully accept all terms, conditions, risks, and consequences
